Then is a file with a BigTIFF header which is less than 4 gigabytes in size in violation of the spec? If so, the sample files at (http://www.awaresystems.be/imaging/tiff/bigtiff.html#samples) are all illegal.

Just to be absolutely clear on this, BigTIFF is legit for files of any size. We merely recommend that applications that are confident they'll write TIFFs well below 4 gigabyte in size, use ClassicTIFF format (for now). But that's a recommendation, not a rigid specification nor proposed specification.
