I can certainly understand that at this point where we have a development branch and a maintenance branch that any new feature enhancements should go only into the development branch. But in my mind bug-fixes go in both branches at least until the development branch cuts a versioned release.

I agree with the above. In fact, even once 4.0 is formally released, we should still be willing to apply security fixes to 3.9.X on the branch.
